Гражданство Австралии

Австралия – одна из самых популярных стран для иммиграции. Желающих стать её гражданами привлекает высокий уровень жизни, возможность найти высокооплачиваемую работу или вести свой бизнес, безопасность, мировой уровень образования, климат и многое другое.

Условия для получения гражданства вполне выполнимы, хотя процесс может быть довольно трудоёмким. Необходимо тщательно изучить все требования, подготовиться, и тогда у вас будет шанс стать полноправным гражданином Австралии.

Есть два основных документа, регулирующих порядок получения гражданства Австралии:

  1. Australian Citizenship Act 2007 регламентирует возможность и порядок получения гражданства Австралийского Союза.
  2. Australian Passports Act 2005 регламентирует возможность и порядок получения паспорта Австралийского Союза

Как получить гражданство Австралии?

Согласно Australian Citizenship Act 2007, заявитель может получить Австралийское гражданство следующими способами:

  • По признаку рождения на Австралийской территории (by birth);
  • В процессе усыновления/удочерения Австралийскими гражданами (by adoption);
  • По признаку происхождения (by descent);
  • Путем начального присуждения этого статуса (by conferral).

С 1 октября 2007 года заявители, желающие принять гражданство Австралии путем начального присуждения этого статуса (by conferral), должны:

  • Являться постоянными резидентами.
  • Удовлетворять требованиям ценза оседлости. Требования по цензу оседлости выполнены в случае, когда заявитель прожил в Австралии 4 года, из них 12 последних месяцев перед подачей заявления на гражданство Австралии на ПМЖ визе. На момент подачи заявления на гражданство необходимо физически присутствовать в Австралии. При этом, заявитель не должен отсутствовать в Австралии более 365 дней перед подачей документов на гражданство Австралии, из них не более 90 дней за последние 12 месяцев перед подачей заявления на гражданство Австралии. Отсчет срока постоянного резидентства начинается с дня въезда в Австралию для тех, кто в момент подачи заявления находился вне Австралии, и со дня выдачи визы для тех, кто находился в Австралии.
  • Быть 16 лет и старше на момент подачи заявления (для самостоятельной подачи заявления).
  • Сдать компьютеризированный тест на гражданство, касающийся различных аспектов официальной жизни общества, австралийских обычаев, национальных праздников и тому подобного.
  • Продемонстрировать высокий уровень интеграции в Австралийское общество (наличие или поиск работы, учёба, волонтёрство, членство в общественных организациях и объединениях, клубах; уплата налогов, учёба детей в австралийских учебных заведениях).
  • Успешно пройти проверку на добропорядочность – character test, в том числе и отсутствие криминального прошлого/судимостей.

Продолжительность физического присутствия в Австралии с целью выполнения ценза оседлости не может включать период тюремного заключения или нахождение на стационарном психиатрическом лечении по решению суда, вынесенном на основании нарушения австралийских законов, за исключением ограниченного круга обстоятельств.

Какие преимущества даёт наличие паспорта/гражданства Австралии?

Получение гражданства Австралии “путем начального присуждения гражданства” влечёт за собой следующие очевидные и не очевидные преимущества:

  • Возможность безвизового проживания в Австралии.
  • Возможность сохранить своё предыдущее гражданство (гражданства).
    Возможность получить дополнительное гражданство третьей страны, например, Канады, после принятия гражданства Австралии, сохранив при этом гражданство Австралии.
  • Возможность получения статуса австралийского гражданина “по происхождению” для ребенка, родившегося как на территории Австралии, так и вне территории Австралии с момента принятия одним из его родителей гражданства Австралии. Можно говорить о своеобразной “передаче по наследству статуса гражданина Австралии для всех детей, родившихся после обретения заявителем гражданства Австралии”, не зависимо от того, где они родились, и какое у них ещё гражданство.
  • Возможность получения австралийского паспорта, позволяющего пересекать австралийскую границу любое количество раз без необходимости получения визы “Возвращающийся резидент” (Resident Return Visa) по истечении срока действия начальной ПМЖ визы.
  • Возможность безвизового пребывания в большинстве стран мира. Австралийский паспорт является одним из наиболее привлекательных из-за лидирующих позиций по количеству стран, посещение которых не требует от обладателя австралийского паспорта получения визы.
  • Возможность в случае необходимости при пребывании вне Австралии обратиться и получить реальную помощь австралийских дипломатических миссий вне территории Австралии.
  • Возможность принимать участие в выборах членов австралийских правительств на любом уровне.
  • Возможность быть избранным в Парламент и другие органы власти Австралии.
    Право получить работу на государственном уровне, требующую наличия гражданства Австралии, а значит возможности “получить допуск” как обязательного условия для “работы на правительство”.
  • Возможность служить в Вооруженных Силах Австралии.
  • Возможность получить от государства беспроцентный образовательный кредит для обучения в высших учебных заведениях Австралии на очень льготных условиях.
  • Возможность получать льготы и пособия системы социального обеспечения Австралии Centrelink на себя и детей.

Могут ли быть отказы/сложности при получении гражданства Австралии?

Процесс получения гражданства Австралии по сути прямолинеен. Для большинства иммигрантов получение гражданства Австралии сводится к получению постоянной визы (ПМЖ) и последующему проживанию в Австралии в течение минимум четырех лет. Дополнительно Australian Citizenship Act 2007 предусматривает ряд исключений к продолжительности ценза оседлости в сторону его уменьшения.

Отказ/сложности в получении положительного решения при получении гражданства Австралии может иметь место по ряду причин, например:

Refunds policy

  1. As soon as payment is received, the client is deemed to have engaged our services. Our service is our professional advice and expertise. Once the service has been provided to the client it cannot be returned.
  2. There is no refund of any fees paid to us where the client’s visa application has been lodged to the Department of Immigration.
  3. Where a client pays us for an assessment service /consultation to review the clients profile or documents for eligibility to apply for a visa or related matters, the assessment /consultation fees are non-refundable once we have started to assess the clients profile or should the client decide for any reason not to proceed.
  4. If a client application becomes ineligible due to Australian Government, Immigration law or Immigration Authorities policy changes that have been introduced after the client engages to us and prior to a visa or citizenship application being lodged or relevant skills assessing authorities, there is no refund of our professional fees.
  5. If a client wishes to discontinue an application and that application has not been submitted to the Immigration Authorities, there is no refund of our professional fees.
  6. Disbursement fees such as Immigration or skills assessing authority application fees can only be refunded to clients where the application has not yet been submitted to the authorities.
  7. If a client wishes to withdraw any application after the application has been lodged to authorities there is no refund of our professional fees or authority application fees
